Property Managers and parking facility owners should read this.

It is not uncommon for apartment managers/owners to accept bribes such as trips to Las Vegas, the Caribbean, parking lot striping, signage,
parking permits and lots of other perks from towing companies to enforce their (towing company) parking rules.

Parking facility owners or property managers face being arrested for violating any portion of the Texas Towing Law, since they gave the towing
company authorization to tow.  In Austin, the fine per violation is $1064.00, imagine if 10 vehicles were towed illegally from your parking lot,
that would make the total fine $10,640.00. Think your towing company is going to pay for fine or bail you out of jail, we seriously doubt it, since
the wrecker driver(s) will be fined the same amount, in addition to losing their wrecker license.

parking or designated spaces not properly marked, or as the picture with the mailboxes, parking in spaces marked in the back of the
space and not marked in the front of the space.  If the red and white towing sign posted when entering the parking facility states,
Resident By Permit in Designated Spaces, or just mentioned in Designated Spaces like the two above, you were illegally towed.
Any parking space that is restricted or designated for someone or permit, must be posted as in the left picture below.

The Austin Police Department  Wrecker Enforcement Unit encourages other "law enforcement agencies" to contact
them for procedures on enforcing criminal illegal towing.
The Austin Police Department Wrecker Enforcement Unit is
the
Flagship Law Enforcement Agency in criminal matters directly related to towing companies, wrecker drivers
and parking facilities.

Allowing towing companies to commit criminal acts against your citizens and do nothing is just plain wrong,
irresponsible, not to mention an insult to be meaning of law enforcement.

Please file a complaint against a towing company, wrecker driver or vehicle storage facility regarding
their rude conduct towards you, refusing to release your vehicle within one hour's notice, refusing to
provide the name, address, phone number to the person who authorized the towing of your vehicle or
refusal to provide their insurance information, without hesitation, please file a complaint by clicking

To find out license, insurance or nonconsent tow fee schedule information on a specific towing company or
vehicle storage facility, click
here to the State of Texas database. When calling the storage lot, find out the
towing fee charged and the name of the towing company, then go into this database with the towing
company's name to check to make the towing fee is no higher than what is posted with TDLR (the agency
that regulates the towing and vehicle storage industry)

The one thing the motoring public can do, is to call, email and write your Texas state Senator or House
Representative, and demand they sponsor legislation, to amend:

Occupations Code 2308.405 to read: A violation of this chapter is a Class B Misdemeanor
punishable by:  (1) a fine not to exceed $2,000;  (2) confinement in jail for a term not to
exceed 180 days; or  (3) both such fine and confinement.

Occupations Code 2308.453 to read, "A hearing under this chapter shall be in the justice
court having
jurisdiction in the precinct in which the parking facility is located", and if the
storage facility fails to provide the name, address, and telephone number of the person,
property owner, or law enforcement agency that authorized the removal of the vehicle,
the fourteen (14) day deadline for filing the request under Sec. 2308.452 does not apply.

A registered vehicle owner and voter should be allowed to vote for the Judge hearing
their tow hearing, instead of having to drive to another county or precinct. The original
statute required the tow hearing to be held in the precinct the parking facility was
located, but the towing industry lobby had it changed to benefit their bottomline.

It's bad enough that you get burned by the towing company that the hearing to determine
if probable cause existed to have your vehicle towed, is held in a court, that Judge is close
friends or related with towing company owner or attorney, thanks to campaign contributions, bar tabs.

STOP THIS JUDICIAL MADNESS AND RETURN THE HEARING TO YOUR ELECTED JUDGES!
