We are a nonprofit organization that provides victims of illegal towing the facts about how win in Court.
In addition, we offer the unique ability to listen to victims and give them guidance on the steps of action
they should pursue.
We have helped many motorists that believed they had been illegally towed from a parking lot, by
providing the required statutory violations of the Occupations Code Title 14. Regulation of Motor
Vehicles and Transportation Chapter 2308 to win in Justice Court against the parking facility and
Probable Cause Hearings against the towing company under Subchapter J Occupations Code Title 14.

In 2007, the Texas Legislature assigned the regulation of tow trucks, wrecker drivers, vehicle storage facilities and the Towing Statute regulation to the Texas Department of Licensing and Regulation. The Towing Statute is now located in the Occupation Code Title 14. Regulation of Motor Vehicles and Transportation Chapter 2308.251 thru 2308.407.

An Illegal towing scam that could happen to you.

The red and white towing signs must be posted 24 hours prior to the towing of a vehicle without the vehicle
owner or operator consent. Furthermore, it is the responsibility of the parking facility to install the statutory
required signs at every curbcut (driveway) that a vehicle may enter the parking facility. Exits are not mentioned
in State Law. Should your vehicle be towed from a parking lot that has no red and white towing sign(s) posted,
please file an online complaint against the towing company, so they can be assessed an administrative fine by the
State agency that regulates them.
It's very important to remember when filing a request for a hearing to determine if probable cause existed to have
your vehicle towed, that you include the legal name of the parking facility (can be found on appraisal district
website), the property management company, the property manager, the towing company and the vehicle storage
facility. Having all these individuals appear in Court could have a Judgement entered against all of them. Winning
a judgement against the towing company doesn't mean you will get reimbursed. Towing companies are notorious
for not refunding money even with the Judge ruling the tow was illegal and in your favor.
Make absolutely sure whether you win or lose a tow hearing case against a towing company, that you submit a
complaint online with TDLR, so an administrative fine can be levied against the towing company licensee.

A victim, being a vehicle owner or operator, who's vehicle was towed and placed into storage without their
consent, has the right to represent themselves in Court without an attorney. We are not attorneys, but get
quite a few calls and emails from attorneys seeking specific information regarding the towing statutes.
But, if you want to take your case to Court without an attorney, that's your right, just expect the other
parties' attorney to send lots of legal documents the average person would take days figuring out. We saw
that problem with a victim (average Joe Q Citizen) going after Compass Bank, in the end, Compass settled
after we proved they violated the Law, evening after being represented by Hirsch & Westheimer of Houston.
I have a hard time understanding why attorneys will not accept more litigation cases for victims when their
cause of action is without a doubt valid. The Texas Legislature in the last session increased the dollar amount
in Justice Courts where these case are plead to $10,000, giving an attorney close to $8000 to work with for
attorney fees and the victim recovering all their money.
Over the past 20 years, I've received brief requests from the Texas Attorney General's Opinion Committee,
that I responded, in reference towing and vehicle storage facility issues. Testified in various House and Senate
committees fighting the towing lobby and parking facility owners over reducing their liabilities for their
criminal involvement.

I've worked in the towing industry, public and private, since the mid ‘70s throughout the state
of Texas. From the days of working for Richard’s Wrecker Service in Port Arthur, to
Trammell’s Wrecker Service in Houston, to Johnny Bates in San Antonio and back to Austin
retiring after working with Bernie’s Towing Service Inc.
From the ground floor of driving a tow truck to managing a towing or vehicle storage
company, I have seen just about every trick that towing companies, wrecker drivers and
vehicle storage facilities pull to rip off the public.
I have testified at many committee hearings during past legislative sessions to keep intact the
very law that I presented for passage back in 1992 to then Rep Glen Maxey.
I created this website (www.texastowingcompliance.com) for victims of what I call illegal
towing, so that consumers, who have never had to deal with these issues, will have a better
understanding of their rights and what they should do, in an attempt to recover monetary
damages.
After becoming disabled in 2001, not being able to remain in the workforce, I dedicate my time
in talking to victims who call my victim’s HOTLINE 512-680-3190, about their horrible
experience with a towing company and vehicle storage facility.
What really disturbs me is that a large number of local law enforcement agencies refuse to
accept the fact that their longtime friends in their community towing companies are committing
criminal offenses against their citizens and do absolutely nothing about it. This has to stop!
If a local police department is unaware of the criminal offenses associated with Texas Towing
Law, then they should educate themselves by calling 512-974-8122, because allowing criminal
conduct to continue is unacceptable by any means.
